At SkinMaker, we respect the intellectual property rights of others and expect the same from our users. This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for handling copyright infringement claims. If you believe that your copyrighted work has been used without your permission, please follow the procedures outlined below to submit a DMCA notice.

2. Our Content and Volunteer Contributions

Currently, SkinMaker relies on the creativity and contributions of volunteers for the design and creation of overlays. This approach helps us maintain high-quality content while we prepare for full user access. Once we enable full access, all users will have the ability to upload their overlays directly. For now, if you have a design you'd like to see featured on our platform, you are welcome to submit your designs through our Submit Your Overlay page for consideration.

3. Filing a DMCA Notice

If you believe that any content on our site, including overlays created by our volunteers, infringes your copyrights, you may submit a DMCA notice with the following information:

  • Your full name and contact information, including your email address and phone number.
  • A description of the copyrighted work that you claim has been infringed, or, if multiple works, a representative list of such works.
  • A description of the material that is claimed to be infringing and information sufficient to allow us to locate the material (e.g., URL or specific location on the site).
  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  • Your physical or electronic signature.

4. Counter-Notification Procedure

If you believe that content you provided or that you submitted to SkinMaker was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification should include:

  • Your full name and contact information, including your email address and phone number.
  • A description of the material that was removed and the location where it previously appeared (e.g., URL or specific location on the site).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • A statement that you consent to the jurisdiction of the federal district court in your area, or if you are outside of the United States, that you consent to the jurisdiction of any judicial district in which SkinMaker may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
  • Your physical or electronic signature.

5. Response to DMCA Notices

Upon receiving a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material.
  • Notify the contributor who provided the material that it has been removed or disabled.
  • If a counter-notification is received, we may, at our discretion, restore the removed content if we do not receive notice within 10 business days that the original complainant has filed a legal action against the contributor.

6. Volunteers and Submissions

SkinMaker welcomes submissions from volunteers who wish to see their designs featured on our platform. If you would like to share your designs or overlays, please submit them through our Submit Your Overlay page or contact us at [email protected]. By submitting your designs, you confirm that you own the rights to the content or have permission from the rights holder to submit the content to SkinMaker.

7. Good Faith and Misrepresentations

Submitting a false or misleading DMCA notice or counter-notification may result in legal liability. You may be held responsible for damages (including costs and attorneys' fees) if you knowingly make a material misrepresentation that content is infringing or that it was removed by mistake. If you are unsure whether the material you are reporting or counter-notifying about is infringing, you may wish to seek legal advice before submitting a DMCA notice or counter-notification.
